General Terms and Conditions

Welcome to ChicqueModa. Please read these General Terms and Conditions carefully before using our services or making a purchase.

Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

  • Cooling-off Period: the period during which the consumer can exercise the right of withdrawal.
  • Consumer: the natural person who does not act for professional or commercial purposes and concludes a distance contract with the entrepreneur.
  • Distance Contract: an agreement concluded between the entrepreneur and the consumer within the framework of an organised distance sales system without simultaneous physical presence, using exclusively one or more means of remote communication up to and including the conclusion of the contract.
  • Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance.
  • Right of Withdrawal: the possibility for the consumer to cancel the distance contract within the cooling-off period.
  • Durable Medium: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way accessible for future reference for a period of time adequate to the purposes of the information and to reproduce the stored information unchanged.

Article 2 – Applicability

These Terms and Conditions apply to every offer made by the entrepreneur and every distance contract and order concluded between the entrepreneur and the consumer.

Prior to concluding a distance contract, the text of these Terms and Conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed where the Terms and Conditions can be inspected and that they will be sent free of charge upon request.

If the distance contract is concluded electronically, the entrepreneur will provide the consumer with these Terms and Conditions electronically in such a way that the consumer can easily store them on a durable medium.


Article 3 – The Offer

Offers made by the entrepreneur are without obligation and may be changed or withdrawn at any time.

The offer contains a complete and accurate description of the products offered. Images used are a truthful representation of the products but slight differences in color or appearance may occur.

The offer contains all necessary information for the consumer to understand their rights and obligations, including but not limited to price, shipping costs, payment terms, delivery times, and the existence or absence of the right of withdrawal.


Article 4 – The Agreement

The contract is concluded at the moment the consumer accepts the offer and meets the stated conditions.

After electronic acceptance of the offer, the entrepreneur will immediately send an electronic confirmation of receipt. The consumer can dissolve the contract as long as the acceptance confirmation has not been received.

The entrepreneur will take appropriate security measures for electronic data transfer and payment.


Article 5 – Right of Withdrawal

Consumers have the right to cancel the contract within 30 days without giving reasons. The withdrawal period starts the day after the consumer or a representative receives the product.

During this period, the consumer will handle the product and packaging carefully and will only unpack or use it to the extent necessary to determine whether they wish to keep the product.

To exercise the right of withdrawal, the consumer must notify the entrepreneur by written message or email at info@chicquemoda.com within 14 days of receipt of the product.

After notifying, the consumer has 30 days to return the product in its original condition, including all accessories and packaging, following the entrepreneur’s return instructions.

Failure to comply with these deadlines results in the contract being final.


Article 6 – Costs in Case of Withdrawal

The consumer bears the costs of returning the product.

If the consumer has paid any amount, the entrepreneur will refund this amount within 30 days after receiving the returned product or proof of its return.


Article 7 – Price

Prices are fixed during the offer period except for changes due to VAT changes.

Prices exclude customs clearance and import VAT, which are borne by the consumer.

Errors in pricing do not obligate the entrepreneur to supply the product at the incorrect price.


Article 8 – Conformity and Warranty

The entrepreneur guarantees that products comply with the contract, specifications, reasonable requirements for durability and usability, and legal regulations.

Consumers must report defects within 14 days of delivery. Returned products must be unused, in original packaging and condition.

The warranty does not apply if the consumer has repaired or altered the product or if the product was exposed to abnormal conditions or misuse.


Article 9 – Delivery and Execution

The entrepreneur will handle orders with due care.

Delivery is made to the address provided by the consumer.

Orders are processed within 14 days unless otherwise agreed.

If delivery is delayed or impossible, the consumer will be informed within 14 days and any payment will be refunded promptly.

Risk passes to the consumer upon delivery.


Article 10 – Duration and Termination

Contracts for fixed terms will not be renewed automatically unless agreed.

Consumers can terminate contracts at any time respecting agreed notice periods.


Article 11 – Payment

Payments are due within 7 days of order unless otherwise agreed.

Non-payment may lead to charges or collection procedures.


Article 12 – Complaints Procedure

Complaints must be submitted within 7 days of noticing the defect, clearly describing the issue.

The entrepreneur will respond within 14 days or provide a timeframe for response.
